Terms of service

Agreement

These terms apply to the ESmarts360 website and application provided by ESmartsSolution, Pakistan (“we”, “us”). By creating an account or using the service, you agree to these terms on behalf of yourself and the business you register.

The service

ESmarts360 is a web application for managing a business. The features available depend on your industry template, the modules you enable and your plan, as described on the pricing page.

Your account

You must give accurate information when you register and be at least 18 years old, or use the service on behalf of a business that authorizes you. You are responsible for the people you invite, the roles you give them, and keeping sign-in details safe. Tell us at once if you suspect unauthorized access.

Your data

Your business owns the records it enters. You confirm that you have the right to enter personal data about students, parents, customers, patients or staff, and that you use it lawfully. We process it only to provide the service, as described in the Privacy policy. You can export your records at any time while your account is active.

Free trial

New businesses may receive a free trial. When the trial ends, business screens pause until you choose a plan. Your data is not deleted because access paused.

Plans, prices and payment

• Prices are shown on the pricing page in Pakistani rupees (PKR) or other listed currencies. Enterprise plans are quoted on request.
• Paid plans are activated after we verify your payment (bank transfer, JazzCash or Easypaisa, as listed when you pay).
• Monthly and yearly plans run for the period paid. Renew before the end date to avoid interruption.
• We may change prices for future periods with at least 30 days' notice; the price you already paid for a period does not change.
• If you believe you were charged in error, contact us within 14 days of payment and we will review it. Except where the law requires otherwise or we fail to provide the service, fees for a period that has started are not refundable.

Acceptable use

You agree not to:

• Try to access another business's data, or test, break or bypass the security of the service.
• Upload unlawful content, malware or content you have no right to use.
• Use the service for fraud, spam, or any activity that is illegal under the laws of Pakistan, including the Prevention of Electronic Crimes Act, 2016.
• Overload the service, or copy, resell or reverse engineer it.

Suspension and closing

We may suspend an account that breaks these terms, puts the service or other customers at risk, or remains unpaid; where possible we will warn you first. You can stop using the service at any time and ask us to close your account.

Availability and changes

We work to keep the service available, secure and backed up, but we cannot promise it will never be interrupted, for example during maintenance or problems with our providers. We may improve or change features and will tell you about important changes in advance.

Limitation of liability

The service is provided as described on our website. To the extent allowed by law, we are not liable for indirect or consequential losses such as lost profit or lost data caused by events outside our reasonable control, and our total liability for any claim is limited to the fees you paid us in the 12 months before the claim. Nothing in these terms limits liability that cannot be limited by law.

Governing law

These terms are governed by the laws of the Islamic Republic of Pakistan. Any dispute that cannot be settled by discussion will be decided by the competent courts of Pakistan.

Changes to these terms

We may update these terms. We will show the date of the latest version above and notify account owners by email of important changes. Continuing to use the service after a change means you accept the updated terms.
